Terms of Service

By creating an account, signing in (including via Google), or otherwise accessing or using any ArivaanAI product — Arivaan Chat, Arivaan Assistant, Arivaan Studio, Flash Cards, FitMind AI, Trip Planner, the Arivaan Orbit extension, or the developer API (together, the "Services") — you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, do not use the Services.

These Terms form a binding agreement between you and ArivaanAI ("we", "us", "our"), operating from Whitefield, ITPL Main Road, Bengaluru – 560066, Karnataka, India.

You can create an account with an email address and password, or sign in using a supported third-party identity provider (currently Google). You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

You agree to provide accurate, current information (including your country, for billing and tax purposes) and to keep it up to date. One individual or legal entity may not maintain more than one free-tier account to circumvent usage or credit limits.

ArivaanAI is offered on a free tier and paid subscription tiers (currently Free, Pro, and Max), billed in INR or USD depending on your billing region, plus optional one-time credit top-up packs. Current pricing is shown at checkout and on our pricing page and may change with notice.

All products draw from a single shared credit wallet. Credits are consumed as you use AI features across ArivaanAI apps; unused credits do not guarantee availability of any specific feature, model, or provider.

Payments are processed by our third-party payment processors (currently Razorpay for India and international one-time orders). We do not store your full card, UPI, or bank account details ourselves.

You agree to use the Services only for lawful purposes and in accordance with these Terms. You are solely responsible for the prompts, files, and other content you submit ("Input") and for how you use any AI-generated output ("Output").

As between you and ArivaanAI, you retain ownership of the Input you submit. Subject to your plan's terms, you generally own the Output generated for you, to the extent ownership of AI-generated content is recognized under applicable law; because Output may draw on third-party model providers, we cannot guarantee any given Output is free of third-party rights or eligible for exclusive ownership everywhere.

You grant ArivaanAI a limited, worldwide, non-exclusive license to host, store, process, and transmit your Input and Output solely as necessary to provide, maintain, secure, and improve the Services — for example, to generate your requested Output, provide support, and prevent fraud or abuse. We do not use your Input or Output to train shared AI models; see our Privacy Policy for details.

ArivaanAI, our logos, and the underlying platform (excluding your Input/Output and third-party components) are our intellectual property or that of our licensors, and no rights are granted to you except as expressly stated here.

Some Output is generated using third-party AI model providers (currently including OpenAI, Alibaba Cloud's DashScope/Qwen models, and DeepSeek), selected and routed automatically. We do not control, and are not responsible for, the accuracy, completeness, or biases of any underlying third-party model.

AI-generated Output may be inaccurate, incomplete, or misleading ("hallucinated"). You should independently verify any Output before relying on it, particularly for health, travel, financial, legal, or safety-related decisions.

You may stop using the Services and close your account at any time from account settings or by contacting [email protected]. We may suspend or terminate your access if you breach these Terms, misuse the Services, fail to pay applicable fees, or where required by law.

On termination, your right to use the Services ends immediately; provisions that by their nature should survive (including payment obligations already incurred, intellectual property, disclaimers, limitation of liability, and dispute resolution) will survive.

The Services are provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.

To the maximum extent permitted by applicable law, ArivaanAI will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising out of or related to your use of the Services. Our total aggregate liability for any claim relating to the Services is limited to the amount you paid us in the 12 months preceding the event giving rise to the claim (or, for free-tier users, INR 1,000 / USD 12).

You agree to indemnify and hold ArivaanAI harmless from claims, damages, and expenses (including reasonable legal fees) arising from your breach of these Terms, misuse of the Services, or your Input/Output, except where caused by our own breach or negligence.

We encourage you to first contact [email protected] to resolve any dispute informally; we will try to resolve it within 30 days.

These Terms are governed by the laws of India, without regard to conflict-of-laws principles. Subject to the paragraph below, any dispute not resolved informally will be referred to binding arbitration in Bengaluru, Karnataka, India, conducted in English by a sole arbitrator under the Arbitration and Conciliation Act, 1996; courts at Bengaluru, Karnataka have exclusive jurisdiction over any matter not subject to arbitration (such as interim injunctive relief).

If you are a consumer resident in the European Economic Area, the United Kingdom, Switzerland, Australia, Brazil, Canada, or a US state whose law does not permit mandatory pre-dispute arbitration or exclusive foreign jurisdiction for consumer contracts, this clause does not limit your right to bring a claim before the competent court or authority of your own country or state of residence, or to rely on any mandatory consumer-protection provisions of that law.

You may not use the Services if you are located in, or a resident of, a country or region subject to comprehensive trade sanctions, or if you are on any restricted-party list, and you agree to comply with applicable export-control and sanctions laws in your use of the Services.

We may update these Terms from time to time. Material changes will be notified through the Services or by email, and will state a "Last updated" date. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect. Our failure to enforce a right is not a waiver of that right. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. These Terms, together with the Privacy Policy and any product-specific terms, are the entire agreement between you and ArivaanAI regarding the Services. Events beyond our reasonable control (force majeure) excuse delayed performance.
